Please read these Terms & Conditions carefully before accessing or using the ANĀYA website, client portal, programs, services, memberships, sessions, workshops, retreats, organizational programs, or other offerings.
These Terms & Conditions form a legal agreement between you and ANĀYA and govern your use of our website, client portal, digital content, and services.
By accessing or using the Service, purchasing or registering for an offering, creating an account, attending a session, or otherwise participating in an ANĀYA offering, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, together with any applicable service-specific terms, registration terms, waiver, consent form, proposal, statement of work, or other written agreement incorporated by reference.
If you do not agree with these Terms & Conditions, you should not access or participate in the applicable Service.
1. Interpretation and Definitions
1.1 Definitions
For the purposes of these Terms & Conditions:
"ANĀYA," "Company," "We," "Us," or "Our" means Karen Brar, operating under the name ANĀYA, and any applicable business entity through which the services are provided.
"Website" means the ANĀYA website and any associated webpages, currently accessible through anayawithin.com, together with any successor or replacement website.
"Client Portal" means any online platform, application, membership area, course platform, or other digital environment used by ANĀYA to provide services, content, communications, resources, or program access.
"Service" means the Website, Client Portal, programs, sessions, classes, memberships, courses, workshops, retreats, organizational programs, coaching, educational services, digital content, and any other services or offerings provided by ANĀYA.
"Offering" means any individual product, service, program, membership, session, workshop, retreat, group program, organizational program, or other service made available by ANĀYA.
"Client" means the individual or organization that purchases, books, contracts for, or otherwise engages ANĀYA to provide an Offering.
"Participant" means any individual who attends, accesses, or participates in an Offering, whether the Offering is purchased directly by that individual or provided through an Organization.
"Organization" means any corporation, business, charity, non-profit organization, institution, employer, community organization, educational institution, or other legal entity that engages ANĀYA to provide an Offering to its employees, contractors, volunteers, members, leaders, or other participants.
"Organization Agreement" means any proposal, statement of work, service agreement, master services agreement, purchase order, invoice, or other written agreement between ANĀYA and an Organization governing a particular engagement.
"Content" means any written, audio, visual, video, educational, instructional, experiential, or other material provided by ANĀYA, including recordings, presentations, worksheets, practices, meditations, frameworks, methodologies, and other resources.
"Terms" means these Terms & Conditions together with any applicable policies, waivers, consent forms, registration terms, or written agreements incorporated into them.
2. About ANĀYA and the Nature of the Services
ANĀYA provides educational, experiential, reflective, wellbeing, personal-development, and contemplative services.
Depending on the Offering, services may include:
- yoga and movement practices;
- yoga therapy-informed education and practices;
- breathwork and pranayama;
- meditation and mindfulness;
- Yoga Nidra;
- somatic and embodied practices;
- Ayurvedic education and lifestyle practices;
- Vedic teachings and philosophy;
- Jyotisha/astrological education;
- Reiki and other energy-based practices;
- reflective inquiry;
- coaching and mentorship;
- journaling and visualization;
- group facilitation;
- organizational wellbeing and human-capacity programming; and
- other educational or experiential practices described in the applicable Offering.
The specific practices included in an Offering will vary.
ANĀYA does not represent that every practice or service is appropriate for every person.
3. Educational and Wellness Disclaimer
ANĀYA's services are educational, supportive, experiential, and developmental in nature.
Unless expressly stated otherwise in writing, ANĀYA does not provide:
- medical diagnosis or treatment;
- psychotherapy;
- psychiatric treatment;
- psychological diagnosis;
- medical advice;
- emergency mental-health services;
- crisis intervention;
- physiotherapy;
- registered dietitian services;
- legal advice;
- financial advice; or
- other regulated professional services.
Information provided through ANĀYA should not be understood as a substitute for individualized advice from a qualified healthcare, mental-health, legal, financial, or other regulated professional.
You are responsible for determining when additional professional support is appropriate.
Nothing in these Terms prevents you from exercising any rights you may have under applicable law.
4. Eligibility
You must be at least 18 years old to purchase or participate in ANĀYA services unless ANĀYA has expressly agreed otherwise in writing.
By using the Service, you represent that:
- you are legally capable of entering into a binding agreement;
- the information you provide is accurate and complete;
- you will use the Service lawfully; and
- you will comply with these Terms.
If you are accessing the Service on behalf of an Organization, you represent that you have authority to do so on behalf of that Organization.
5. Website and Client Portal Use
You may use the Website and Client Portal only for their intended purposes.
You agree not to:
- misuse the Service;
- interfere with its operation or security;
- attempt to gain unauthorized access;
- copy or reproduce proprietary content without permission;
- share login credentials;
- impersonate another person;
- upload malicious software;
- use the Service for unlawful purposes;
- distribute or commercially exploit ANĀYA Content without written permission; or
- use another participant's personal information for any unauthorized purpose.
ANĀYA may suspend or terminate access where reasonably necessary to protect the Service, ANĀYA, its participants, or third parties.
6. Accounts and Login Credentials
Where an account is required, you are responsible for providing accurate and current information.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You must notify ANĀYA promptly if you believe your account has been compromised or accessed without authorization.
You may not share your account or login credentials with another person unless ANĀYA expressly permits it.
ANĀYA reserves the right to suspend or terminate accounts that are used in breach of these Terms.
7. Individual Services
Individual services may include mentorship, coaching, educational sessions, personal practices, consultations, or other one-to-one services.
The scope, duration, price, frequency, and format of an individual service will be communicated at the time of booking or purchase.
Unless expressly agreed otherwise, an individual service does not create an ongoing obligation for ANĀYA to provide services beyond the specific engagement purchased.
Participation remains voluntary and does not guarantee any particular personal, emotional, professional, health, financial, spiritual, or other outcome.
8. Group Programs and Group Coaching
ANĀYA may offer group programs, workshops, courses, classes, group coaching, facilitated discussions, educational series, and other group experiences.
Group programs may be delivered:
- online;
- in person;
- through the Client Portal;
- through live video conferencing;
- through pre-recorded content; or
- through a combination of these formats.
Group programs may involve personal reflection, discussion, movement, breathwork, meditation, somatic practices, journaling, experiential exercises, and participant interaction.
Participation in a group does not guarantee individualized attention or individualized advice.
Participants remain responsible for determining whether a particular practice is appropriate for them.
9. Organization and Corporate Programs
The following provisions apply to any program or service provided to or through an Organization.
9.1 Organization as Contracting Client
Where an Organization engages ANĀYA, the Organization is the contracting client and is responsible for the obligations assigned to it under the applicable Organization Agreement.
These may include:
- payment of fees;
- scheduling;
- participant communications;
- venue arrangements;
- technology;
- participant registration;
- organizational approvals;
- workplace policies;
- accessibility requirements;
- health and safety responsibilities; and
- other matters within the Organization's control.
The Organization Agreement will govern the specific scope, fees, dates, deliverables, participant numbers, cancellation terms, and other commercial terms of the engagement.
9.2 Participant Relationship
Participants in Organization-sponsored programs may include employees, contractors, volunteers, members, leaders, or other individuals invited by the Organization.
A Participant may be required to complete ANĀYA's participant consent and waiver before participating.
Participation in an Organization-sponsored program does not create an employment, agency, partnership, fiduciary, therapeutic, medical, or other professional relationship between ANĀYA and the Organization or Participant except as expressly stated in writing.
9.3 No Assumption of Organizational Responsibilities
ANĀYA does not assume responsibility for the Organization's:
- employment practices;
- human resources matters;
- workplace policies;
- occupational health and safety obligations;
- accessibility obligations;
- employee relations;
- workplace investigations;
- performance management;
- disciplinary matters;
- emergency planning; or
- other legal or organizational responsibilities.
The Organization remains responsible for matters within its control.
9.4 No Guarantee of Organizational Outcomes
ANĀYA does not guarantee any particular organizational outcome, including improvements in:
- employee wellbeing;
- productivity;
- engagement;
- retention;
- workplace relationships;
- psychological safety;
- organizational culture;
- absenteeism;
- employee performance; or
- other workplace measures.
Any discussion of potential outcomes is educational or prospective and does not constitute a guarantee.
10. Organization Responsibilities
The Organization agrees to:
- provide accurate information to ANĀYA;
- communicate relevant program information to Participants;
- provide a reasonably safe and appropriate environment for in-person programming;
- provide appropriate technology and access for online programming where applicable;
- identify an appropriate organizational contact;
- communicate relevant emergency procedures where necessary;
- obtain organizational permissions and approvals;
- comply with applicable laws and workplace obligations; and
- fulfill any additional responsibilities identified in the Organization Agreement.
The Organization is responsible for ensuring that its own policies and procedures are appropriate for its employees, contractors, volunteers, and other Participants.
11. Participant Responsibility and Self-Agency
Participation in any ANĀYA Offering is voluntary.
Each Participant remains responsible for their own physical, emotional, mental, and spiritual wellbeing.
Participants may:
- modify a practice;
- decline an exercise;
- pause;
- take a break;
- leave a session; or
- discontinue participation at any time.
Participants are responsible for communicating relevant limitations or concerns where they believe doing so is necessary for safe participation.
ANĀYA does not determine whether an individual is medically, psychologically, physically, or otherwise fit to participate.
12. Physical and Experiential Risks
Some Offerings involve physical movement, stretching, breath practices, stillness, meditation, somatic practices, or other experiential activities.
Participants acknowledge that participation may involve foreseeable risks, including physical discomfort, strain, dizziness, fatigue, emotional activation, changes in breathing, emotional release, or other physical or psychological responses.
Participants voluntarily assume the ordinary and reasonably foreseeable risks associated with their participation, to the fullest extent permitted by applicable law.
Participants should seek appropriate medical or other professional advice where necessary before participating.
13. Online Programs and Technology
Online participation involves risks and limitations associated with technology.
These may include:
- internet interruption;
- software or platform failures;
- device failure;
- audio or video problems;
- telecommunications interruptions;
- privacy risks;
- cybersecurity incidents; and
- other issues associated with third-party technology.
Participants are responsible for having an appropriate device, internet connection, and physical environment for participation.
Participants should choose a safe physical space and should not participate in movement-based practices while driving or while engaged in another activity that creates an unreasonable safety risk.
ANĀYA is not responsible for interruptions or failures caused by third-party technology outside its reasonable control.
14. In-Person Programs
For in-person programs, Participants agree to follow reasonable safety instructions and to use facilities and equipment appropriately.
The Organization or venue is responsible for providing a reasonably safe environment where it has control over the premises.
Participants must notify ANĀYA or the Organization of any immediate safety concern and may stop participating at any time.
ANĀYA is not responsible for hazards or conditions outside its reasonable control.
15. Group Environment, Respect and Confidentiality
Group programs may involve personal reflection and disclosure.
ANĀYA will make reasonable efforts to foster a respectful and confidential environment.
However, ANĀYA cannot guarantee that other Participants will maintain confidentiality.
Participants agree to respect the privacy of others and agree not to:
- disclose another Participant's personal information;
- repeat personal disclosures outside the group;
- photograph another Participant without consent;
- record another Participant;
- screenshot another Participant;
- distribute session content containing another Participant; or
- otherwise use another Participant's personal contribution without appropriate consent.
Participants should exercise discretion when sharing sensitive personal information in a group environment.
16. Organizational Reporting and Participant Information
Where an Organization has commissioned a program, ANĀYA may provide the Organization with appropriate administrative or program-level information, including:
- attendance;
- completion;
- scheduling information;
- participation rates;
- aggregated feedback;
- aggregated evaluation results; and
- general program observations.
Unless otherwise agreed in writing or required or permitted by law, ANĀYA will not provide an Organization with a Participant's private personal disclosures or individualized therapeutic, psychological, medical, or other sensitive information merely because that person participated in a program.
Where disclosure is required or permitted by law, or is reasonably necessary to address an immediate safety concern, ANĀYA may disclose information to the extent reasonably necessary.
17. Privacy and Personal Information
ANĀYA may collect personal information necessary to provide its Services, process payments, communicate with Clients and Participants, administer programs, maintain accounts, and fulfill legal and contractual obligations.
Personal information may include information such as:
- name;
- email address;
- telephone number;
- billing information;
- account information;
- registration information;
- attendance;
- communications;
- program participation information; and
- other information reasonably required to provide the Service.
ANĀYA will collect, use, retain, and disclose personal information in accordance with its Privacy Policy and applicable privacy legislation.
Depending on the circumstances, applicable privacy obligations may include federal or provincial privacy legislation.
For commercial activities, PIPEDA establishes principles governing the collection, use and disclosure of personal information, including meaningful consent, limiting collection, safeguards, openness, access, and accountability.
Participants may contact ANĀYA regarding questions about their personal information or privacy practices at:
18. Third-Party Platforms and Services
ANĀYA may use third-party platforms and service providers to provide its Services, including payment processors, video-conferencing platforms, email providers, scheduling systems, client-management systems, hosting providers, and other technology services.
Your use of those services may also be subject to the third party's own terms and privacy policies.
ANĀYA does not control third-party platforms and is not responsible for their independent acts, omissions, policies, security practices, availability, or performance.
Where third-party services are necessary to provide an Offering, you consent to the use of those services as reasonably necessary to provide the Service.
19. Fees and Payments
Fees will be communicated at the time of purchase, registration, booking, or contracting.
Unless otherwise stated, all amounts are in Canadian dollars.
Applicable taxes will be charged where required by law.
Payment may be processed through third-party payment providers.
You authorize ANĀYA and/or its payment processor to charge the applicable payment method for amounts properly due.
You agree to provide accurate billing information.
ANĀYA is not responsible for delays caused by payment-provider authorization failures.
20. Memberships and Subscriptions
Where an Offering is provided through a recurring membership or subscription, the applicable membership fee, billing frequency, renewal terms, and cancellation provisions will be disclosed before purchase.
Unless otherwise stated, subscriptions automatically renew at the applicable renewal interval until cancelled.
You may cancel future renewals in accordance with the cancellation instructions provided with the applicable subscription.
Cancellation of a subscription does not automatically entitle you to a refund for amounts already paid, except where required by applicable law or expressly stated otherwise.
Nothing in this section limits any statutory cancellation or refund rights that may apply.
21. Personal Development Services and Statutory Consumer Rights
Certain ANĀYA offerings may fall within the definition of "personal development services" under Ontario consumer protection legislation.
Where applicable, ANĀYA will comply with mandatory requirements governing such services, including requirements relating to contract terms, payment, cancellation, and refunds.
Ontario legislation provides specific cancellation rights for qualifying personal development services agreements, including a statutory cooling-off period in certain circumstances.
Nothing in these Terms is intended to waive, restrict, or exclude a consumer right that cannot legally be waived or excluded.
Where applicable law provides a greater right or protection than these Terms, the applicable law will prevail.
22. Internet and Electronic Agreements
Where you enter into an agreement with ANĀYA electronically, you acknowledge that electronic communications, electronic acceptance, and electronic signatures may be used to form and evidence the agreement.
Ontario's Electronic Commerce Act recognizes electronic contracts and electronic signatures in circumstances governed by the Act.
Where required by applicable consumer protection legislation, ANĀYA will provide the required information before acceptance and will provide a copy of the agreement in the required manner.

23. Cancellations, Rescheduling and Refunds
Cancellation and refund terms may vary depending on the Offering and will be disclosed at the time of purchase or booking.
Unless a different policy is expressly stated for a particular Offering:
- individual sessions may be subject to a cancellation or rescheduling period communicated at booking;
- group programs may have fixed start dates and participation requirements;
- memberships may be cancelled for future billing periods in accordance with the applicable subscription terms;
- digital content may be subject to restrictions once access has commenced, subject always to applicable law; and
- retreat and travel cancellations may be governed by separate terms provided at the time of booking.
Nothing in these provisions limits statutory cancellation, refund, or other consumer rights.
24. Changes, Substitutions and Program Modifications
ANĀYA reserves the right to make reasonable changes to an Offering where necessary, including changes to:
- scheduling;
- instructors or facilitators;
- session format;
- content;
- location;
- technology;
- sequence;
- delivery method; or
- other operational details.
Where a material change substantially affects the Offering, ANĀYA will make reasonable efforts to notify affected Clients.
Where circumstances outside ANĀYA's reasonable control prevent delivery, ANĀYA may reschedule, substitute, modify, or otherwise reasonably adjust the Offering.
Any refund or credit arising from such circumstances will be determined in accordance with the applicable agreement and applicable law.
25. Intellectual Property
All original Content created or provided by ANĀYA remains the property of Karen Brar / ANĀYA or its licensors unless otherwise expressly agreed in writing.
This includes, without limitation:
- written materials;
- presentations;
- frameworks;
- methodologies;
- teachings;
- recordings;
- meditations;
- practices;
- worksheets;
- workbooks;
- program structures;
- course materials;
- graphics;
- videos;
- audio;
- trademarks;
- logos; and
- other original materials.
Participation in a program does not transfer ownership of ANĀYA's intellectual property.
You may use materials provided to you for your personal, non-commercial use unless otherwise stated.
You may not reproduce, distribute, publish, sell, sublicense, modify, teach, record, commercially exploit, or create derivative works from ANĀYA's proprietary materials without prior written permission.
26. Organization Use of Materials
Where an Organization purchases an ANĀYA program, the Organization receives only the rights expressly granted in the applicable Organization Agreement.
Unless otherwise agreed in writing, the Organization may not:
- reproduce ANĀYA's proprietary materials;
- distribute materials outside the contracted program;
- repurpose ANĀYA's methodology as its own;
- train internal staff using ANĀYA's proprietary materials;
- record or reproduce ANĀYA's sessions;
- commercially exploit ANĀYA's Content; or
- provide ANĀYA's materials to third parties.
Any broader organizational license must be agreed in writing.
27. Recording, Photography and Media
ANĀYA may not record an online or in-person group session for promotional, educational, training, or other purposes without appropriate notice and consent where required.
Participants and Organizations may not independently record, photograph, screenshot, livestream, reproduce, or distribute an ANĀYA session or another Participant without appropriate permission.
Where ANĀYA intends to use photographs, video, testimonials, recordings, or other identifiable participant material for promotional purposes, appropriate consent will be obtained where required.
A media or promotional consent may be requested separately from these Terms.
28. Participant Conduct
ANĀYA is committed to creating respectful and inclusive learning environments.
Participants agree not to engage in conduct that is:
- threatening;
- abusive;
- harassing;
- discriminatory;
- sexually inappropriate;
- materially disruptive;
- unsafe;
- unlawful; or
- materially harmful to another Participant or the integrity of the program.
ANĀYA may remove or restrict a Participant where reasonably necessary to protect the safety or wellbeing of others or the integrity of the program.
Where participation is Organization-sponsored, ANĀYA may communicate relevant conduct concerns to the Organization where reasonably necessary and permitted by law.
29. Emergency Situations
ANĀYA's services are not emergency services.
If an emergency occurs during an Offering, ANĀYA may contact emergency services, an emergency contact, the Organization, or another appropriate person where reasonably necessary to protect the health or safety of a Participant or others.
Participants are responsible for providing accurate emergency contact information where requested.
ANĀYA cannot guarantee the availability or adequacy of emergency services.
30. Retreats and Immersive Travel
Additional risks apply to retreats and immersive travel experiences.
Participants acknowledge that such experiences may involve:
- transportation;
- accommodations;
- unfamiliar environments;
- outdoor activities;
- physical movement;
- weather;
- terrain;
- food;
- altitude;
- local conditions;
- cultural differences;
- schedule changes;
- shared accommodations; and
- third-party providers.
Participants are responsible for assessing their own readiness to participate and obtaining appropriate travel, medical, cancellation, or other insurance.
Where ANĀYA coordinates or recommends third-party providers, those providers remain responsible for their own services.
ANĀYA is not responsible for the independent acts or omissions of third-party travel providers except to the extent required by applicable law.
Separate retreat or travel terms may apply.
31. Assumption of Risk
By participating in an Offering, you acknowledge that you understand that participation may involve physical, emotional, psychological, experiential, environmental, technological, and other risks.
You voluntarily assume the ordinary and reasonably foreseeable risks associated with participation, to the fullest extent permitted by applicable law.
You acknowledge that individual outcomes vary and that ANĀYA cannot guarantee a particular result.
32. Waiver and Release of Liability
To the fullest extent permitted by applicable law, you acknowledge and agree that participation in ANĀYA Offerings is undertaken voluntarily and at your own risk.
To the fullest extent permitted by law, you release and waive claims against Karen Brar / ANĀYA and its owners, contractors, facilitators, instructors, and service providers arising from your participation in an Offering, including claims relating to ordinary and reasonably foreseeable risks associated with the activities provided.
This release is not intended to exclude or limit liability to the extent that applicable law prohibits such exclusion or limitation, including liability that cannot lawfully be waived.
Nothing in these Terms limits any statutory rights or remedies that cannot legally be excluded.
Where a separate participant waiver or consent form is provided, that document forms part of the agreement governing participation.
33. Limitation of Liability
To the fullest extent permitted by applicable law, ANĀYA will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Service or participation in an Offering.
This includes, where legally permissible, losses such as:
- loss of profits;
- loss of business;
- loss of productivity;
- business interruption;
- loss of data;
- reputational loss; or
- other indirect losses.
ANĀYA's liability, where liability is legally established and subject to any mandatory statutory rights or remedies, will be limited to the amount paid by the Client for the specific Offering giving rise to the claim.
Where an Organization and ANĀYA have entered into a separate written agreement containing negotiated liability provisions, those provisions will govern.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
34. Organization Indemnification
To the fullest extent permitted by applicable law, an Organization agrees to indemnify and hold harmless ANĀYA, Karen Brar, and ANĀYA's contractors, facilitators, and service providers from claims, losses, damages, liabilities, costs, and reasonable expenses arising from:
- the Organization's breach of its obligations;
- the Organization's negligence or willful misconduct;
- unsafe premises or conditions under the Organization's control;
- the Organization's failure to comply with applicable law; or
- the acts or omissions of the Organization or its personnel,
except to the extent that the claim arises from ANĀYA's own negligence, willful misconduct, or other liability.
Where a separate Organization Agreement contains negotiated indemnification provisions, those provisions will govern.
35. No Guarantee of Results
ANĀYA makes no guarantee regarding the results of any Offering.
Examples of outcomes that cannot be guaranteed include:
- physical improvements;
- emotional changes;
- stress reduction;
- behavioural changes;
- professional development;
- organizational change;
- improved workplace relationships;
- increased productivity;
- improved wellbeing;
- financial outcomes;
- spiritual development; or
- any other specific result.
Testimonials or examples of other Participants' experiences are illustrative only and do not guarantee that you will experience the same result.
36. Third-Party Links
The Website or Service may contain links to third-party websites, products, platforms, or services.
ANĀYA does not control those third parties and is not responsible for their content, policies, availability, security, or practices.
Your use of third-party services is subject to their applicable terms and policies.
37. Force Majeure
ANĀYA will not be responsible for delay or failure to perform caused by circumstances beyond its reasonable control.
These circumstances may include:
- illness;
- injury;
- death;
- natural disasters;
- severe weather;
- fire;
- power failure;
- internet or technology failure;
- government restrictions;
- public-health events;
- transportation disruptions;
- labour disruptions;
- civil disturbance; or
- other circumstances beyond reasonable control.
Where reasonably possible, ANĀYA will attempt to reschedule or provide an alternative method of delivery.
38. Termination and Suspension
ANĀYA may suspend or terminate access to the Service where reasonably necessary, including where:
- these Terms are breached;
- payment obligations are not met;
- there is misuse of the Service;
- conduct creates a safety concern;
- intellectual property is misused;
- account security is compromised; or
- continued participation is otherwise reasonably determined to be inappropriate.
Termination does not eliminate obligations that accrued before termination.
39. Dispute Resolution
If you have a concern or dispute relating to an Offering or the Service, you agree to first contact ANĀYA and make a reasonable effort to resolve the matter informally.

Nothing in this section prevents a person from exercising a statutory right, filing a complaint with a regulatory authority, or pursuing a remedy that cannot legally be restricted.
Where an Organization Agreement contains a separate dispute-resolution procedure, that procedure will apply to disputes between ANĀYA and the Organization.
40. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory statutory rights, disputes will be addressed in the applicable courts or tribunals of Ontario.
41. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.
The remaining provisions will continue in effect.
42. No Waiver
Failure by ANĀYA to enforce any provision of these Terms does not constitute a waiver of that provision or ANĀYA's right to enforce it later.
43. Entire Agreement and Order of Precedence
These Terms, together with any applicable Privacy Policy, participant waiver, registration terms, and written service agreement, form the agreement governing your use of the Service.
For Organization engagements, where an Organization Agreement conflicts with these general Terms, the Organization Agreement will govern with respect to the specific conflict.
For mandatory statutory rights, applicable legislation will prevail over any conflicting contractual provision.
44. Changes to These Terms
ANĀYA may update these Terms from time to time.
When changes are material, ANĀYA will make reasonable efforts to provide notice where appropriate.
The updated Terms will become effective on the date specified in the updated Terms.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms, except where applicable law requires a new agreement or express consent.
45. Electronic Acceptance
Where the Service provides an electronic checkbox, signature field, button, or other mechanism for acceptance, selecting or completing that mechanism constitutes your acknowledgment and acceptance of the applicable Terms to the extent permitted by law.
You may be asked to separately acknowledge:
- these Terms & Conditions;
- an Informed Consent & Waiver of Liability;
- a Privacy Policy;
- a service-specific cancellation policy;
- an Organization Agreement; or
- another applicable consent.
Electronic acceptance may be retained as evidence of your agreement.

- I understand that ANĀYA's services are educational, experiential, and supportive in nature;
- I understand that ANĀYA does not provide medical or mental-health treatment unless expressly stated otherwise;
- I understand that participation is voluntary;
- I accept responsibility for my own participation and wellbeing;
- I understand the risks associated with participation;
- I agree to comply with reasonable participant conduct and confidentiality expectations;
- I understand that group confidentiality cannot be guaranteed;
- I agree to the applicable Informed Consent & Waiver of Liability;
- I understand that additional terms may apply to specific Offerings; and
- I agree to be bound by these Terms & Conditions to the fullest extent permitted by law.
